What is a California Simplified Divorce?

While there are many different kinds of divorce that a couple can get in California, most of them deal with a specific division of assets. The simplified divorce is intended for people that do not have assets nor have not been married for as long. This type of divorce is no-fault, typically takes as long as the other types of divorce to process in court, but the paperwork is different and couples are required to represent themselves in court rather than having attorney representation. This type of divorce usually occurs much quicker than the other types of divorce.

San Jose Simplified Divorce Requirements

The first thing that the couple needs to do is file for divorce with no fault grounds. If specific requirements are met, then the no-fault divorce is simplified. The simplified divorce is usually a less expensive, quicker, and less stressful way to get divorced. However, to be eligible for a simplified divorce, you need to meet the following requirements:

  • California residency
  • Married for less than five years
  • No children or pregnancy during time of filing
  • No more than $4000 in joint debt, excluding car loans
  • No property owned together

In addition to the above requirements, neither party can have more than $25,000 in property. In addition, there cannot be more than $25,000 of property owned together.
